Foreclosure Defense

Among other things, Church of the Gardens is actively researching, documenting and exposing relevant information that can potentially benefit many people in the area of Foreclosure Defense.

Regarding "Takings"

This page contains research relating to assertions that governments’ change of laws to allow the enforcement of lost and destroyed promissory notes secured by deeds of trust against homeowners, which require homeowners to bear the public burdens caused by the financial industry’s destruction and loss of promissory notes, constituted a governmental “taking” in violation of the Fifth and Fourteenth Amendments to the United States Constitution.  

The Fifth Amendment to the United States Constitution states in relevant part: “No person shall be … deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.” 

The italicized portion of the Fifth Amendment shown above is known as the Takings Clause. “A principle purpose of the Takings Clause is to bar Government from forcing some people to bear public burdens which, in fairness and justice, should be borne by the public as a whole.” Murr v. Wisconsin, 137 S. Ct. 1933, 1950, 198 L.Ed.2d 497, 517 (2017) quoting Armstrong v. United States, 364 U.S. 40, 49, 80 S. Ct. 1563, 4 L. Ed. 2d 1554 (1960). 

The Fourteenth Amendment made the Fifth Amendment applicable to the States, including Washington State. See generally Rappaport, Originalism and Regulatory Takings: Why the Fifth Amendment May Not Protect Against Regulatory Takings, but the Fourteenth Amendment May”, 45 San Diego L. Rev. 729 (2008) (describing the debate among scholars over those questions, which are primarily applicable to regulatory takings, not the governmental seizure of real property which undeniably constitute “takings”).

Regarding the "Contract Clause"

The United States Constitution, Article I, Section 10, Clause 1, says:

No State shall enter into any Treaty, Alliance, or Confederation; grant Letters of Marque and Reprisal; coin Money; emit Bills of Credit; make any Thing but gold and silver Coin a Tender in Payment of Debts; pass any Bill of Attainder, ex post facto Law, or Law impairing the Obligation of Contracts, or grant any Title of Nobility.

State courts, including Washington courts and judicial officers, do not have the authority to rewrite laws so as to allow state governments to impair contracts. Jefferson Branch Bank v. Skelly, 66 U.S. (1 Bl.) 436, 443 (1862); Bridge Proprietors v. Hoboken Co., 68 U.S. (1 Wall.) 116, 145 (1863); Wright v. Nagle, 101 U.S. 791, 793 (1880); McGahey v. Virginia, 135 U.S. 662, 667 (1890); Scott v. McNeal, 154 U.S. 34, 35 (1894); Stearns v. Minnesota, 179 U.S. 223, 232–33 (1900); Coombes v. Getz, 285 U.S. 434, 441 (1932); Atlantic Coast Line R.R. v. Phillips, 332 U.S. 168, 170 (1947).

The following documents and filings, many of which may be judicially noticed under federal and Washington law, are evidence of homeowners’ Takings and Contract theories challenging the constitutional appropriateness of changing laws so as to allow foreclosures of contracts that were otherwise not enforceable under state law. In Washington, this law is Washington’s Uniform Commercial Code which requires that persons entitled to enforce a promissory note must have actual possession of the note which was actually signed by its maker or be able to comply with RCW 62A.3-309(a) which states:

(a) A person not in possession of an instrument is entitled to enforce the instrument if (i) the person was in possession of the instrument and entitled to enforce it when loss of possession occurred, (ii) the loss of possession was not the result of a transfer by the person or a lawful seizure, and (iii) the person cannot reasonably obtain possession of the instrument because the instrument was destroyed, its whereabouts cannot be determined, or it is in the wrongful possession of an unknown person or a person that cannot be found or is not amenable to service of process.

The document above indicates that a reason for the OCC’s warnings to banks that notes should not be destroyed was, in part, based on the reasons stated in this document. History then indicates the Banks continued to destroy the notes, putting the country in a situation where the Banks could blackmail Congress into making consumers responsible for paying these stale debts.
